Certificate of absence of marriage in Ukraine
Certificate of the absence of marriage – a notarial statement (certificate) of marital status in Ukraine.
The rules of state registration established that citizens of Ukraine who need to confirm their marital status abroad need to issue a certificate / statement, which will indicate that the person was not previously married or was, but at the moment the marriage is terminated.
The signature on such a certificate must be certified by a notary in accordance with the Law of Ukraine “On Notaries”. If a citizen of Ukraine is already abroad and does not have the opportunity to apply to a national notary, then the signature should be certified at the Consulate or diplomatic mission.
How and where to get a certificate of marital status in Ukraine?
A certificate of marital status is drawn up from any notary – private / public, who operates on the territory of Ukraine.
There are three options for drawing up a certificate of marital status:
- when it is confirmed that the applicant is not married and has never been;
- when it is confirmed that the applicant is not married at the time of registration of the application, which is confirmed by a divorce certificate;
- when it is confirmed that at the time of registration of the application, the applicant is a widower (widow) and is not married.
It is necessary to choose a template for a certificate of marital status that corresponds to the life circumstances of the applicant. The application is drawn up on an official form of strict accountability, with a corresponding hologram and watermarks.

What is the validity period of the statement about not being married in Ukraine?
The need to issue a certificate of marital status is associated with the registration of marriage with a foreigner abroad. When applying to the appropriate department, citizens of Ukraine are faced with a list of required documents. One of the important documents is a statement that you are not married or a certificate of marital status.
This certificate is drawn up in accordance with Art. 39, 45 of the Family Code, in order to avoid the consequences of an invalid marriage, because a marriage registered with a person who is already legally married is invalid.
Each foreign country has separate requirements for the validity period of a certificate of marital status issued in Ukraine. As a rule, the certificate / application has a validity period of 1 to 3 months (because it is believed that over a long period of time a person can remarry), depending on the circumstances.
It should be noted that a certificate of marital status is drawn up personally, the law excludes representation in this matter.
What is the procedure for legalizing a declaration of marital status in Ukraine?
It should be noted that no matter how the notarial statement of marital status is called – “marriage certificate”, “marriage certificate”, “certificate of absence of marriage”, “certificate of marital status” “statement that you are not married »Etc., for the document to be used abroad, it should be brought into conformity (legalized).
There are several ways to legalize a notarial certificate of marital status, which may include:
- apostille;
- translation into the appropriate language;
- notarization of the translation;
- certification at the consulate.
The notarial statement of marital status submitted for affixing the apostille is considered by the Ministry of Justice of Ukraine.
Based on the results of consideration of the application and the notarial statement on marital status, the official of the Ministry of Justice affixes an apostille or refuses to affix it, using the software to maintain the Register, a corresponding electronic document with the imposition of his own qualified electronic signature and affixing to the document with a qualified electronic seal of the Ministry of Justice of Ukraine.
Apostille affixing on a notarial statement of marital status, refusal to affix it is carried out within 2 working days.
