As you know, in accordance with Part 1 of Art. 12 of the Law of Ukraine “On ensuring the rights and freedoms of citizens and the legal regime in the temporarily occupied territory of Ukraine” due to the impossibility of administering justice by the courts of the Autonomous Republic of Crimea and the city of Sevastopol in the temporarily occupied territories, to change the territorial jurisdiction of court cases within the jurisdiction of the Autonomous Republic of Crimea and the city of Sevastopol courts, and ensure the consideration of: civil cases, subject to local general courts located on the territory of the Autonomous Republic of Crimea and the city of Sevastopol, – local general courts of the city of Kiev, are determined by the Court of Appeal of the city of Kiev.

In order to file for divorce, a person with a Crimean residence permit must travel to the controlled territory of Ukraine to carry out all official actions with state bodies competent in the issue of divorce.

Based on the provisions of the Civil Procedure Code, Art. 27 As a general rule, claims against an individual for divorce are filed in court at the duly registered place of residence or stay, unless otherwise provided by law.

As you can see, the determination of the territorial jurisdiction of the relevant case with the participation of an individual depends on two legal categories:

  • place of residence of an individual
  • place of stay.

Accordingly, if the defendant has a place of registration in the controlled territory of Ukraine, then the claim is brought by the plaintiff at the place of registration of the defendant.

If the defendant has a Crimean residence permit, it is necessary to submit and file a petition for determining jurisdiction to the Kiev Court of Appeal.

Otherwise, it is possible to refer to Art. 28 of the Civil Procedure Code, which states that claims for divorce can be brought at the registered place of residence or stay of the plaintiff also if he is dependent on young or minor children, or if he cannot leave for health reasons or for other valid reasons to the place of residence of the defendant.

By agreement of the spouses, a divorce case, when one of the parties has a Crimean residence permit, can be considered at the registered place of residence or stay of one of them.
