How to withdraw an application submitted to the registry office in Ukraine
If the spouses applied for divorce and was reconciled, then the application for divorce should be withdrawn.
Regarding the withdrawal of the application submitted to the registry office, then if the divorce procedure was started through the registry office, the spouses may withdraw this application or simply do not come on the appointed day to register the divorce. This way the marriage will not be dissolved.
How to withdraw a statement of claim to court in Ukraine
If one of the spouses applied to the court with a statement of claim for divorce and subsequently the spouses decided to keep the marriage, then the spouse who filed the statement of claim with the court must do one of the following:
- send by mail a statement on leaving the claim without consideration;
- before the start of the hearing on the case, enter in the court registry a statement of waiver of the claim;
- submit an application to leave the claim without consideration;
- during the meeting, verbally declare the refusal to divorce and this will also be enough.
After receiving the plaintiff’s refusal to file a claim, the court will simply close the case.
