Repeatedly from the payers of alimony I received a question how to control the spending of alimony, is it possible to check what the alimony funds are spent on?
According to the current legislation, alimony received for a child is the property of the child.
Therefore, the spouse who receives child support must dispose of such funds solely for the intended purpose and in the interests of the child.
By the way, a minor child can also participate in the disposal of such funds.
Intended use of alimony funds in Ukraine
The question arises whether the intended use of funds is to refuel the car in order to take the child to school, or to pay utility bills for the apartment where the child lives.
On the one hand, in this case, the alimony funds were spent on ensuring comfortable conditions for the child, and on the other, not directly on supporting the child.

Therefore, the definition of the intended use of alimony funds for a child is rather ambiguous and relies solely on the opinion of the court or the guardianship and guardianship authorities.
Non-payment of alimony in Ukraine
By the way, if the alimony payer did not pay the alimony and has an arrears in the payment of alimony, then he will not only be liable for non-payment of alimony, but this is also the reason for refusing him to check the intended use of the alimony funds.

If, during the examination of the living conditions of the child, it was not possible to objectively assess the state of satisfaction of his individual needs, the child affairs service or the guardianship and guardianship authorities have the right to apply with a written request to health care institutions and an educational institution, as well as to the provider of housing and communal services with a request for about how utility bills are paid.
The guardianship and trusteeship bodies shall issue an appropriate conclusion within five days from the date of such an inspection.
If in the conclusion of the guardianship and trusteeship authorities in connection with the audit it is really established that the recipient of the alimony is using the funds not for the intended purpose to meet the needs of the child, then the payer of the alimony may apply to the court with a demand to reduce the amount of alimony or make the alimony funds to the child’s bank account …
The court can make a decision to reduce the amount of alimony only if the guardianship and trusteeship authorities establish that the payer of the alimony pays too much alimony and part of the funds is spent not for the intended purpose.
